As many of you already know, in order to maintain immunity for copyright infringement for third party content posted on your website under the Digital Millennium Copyright Act, you must comply with that statute’s requirements including designating an agent with the U.S. Copyright Office. Most of you have already done so.
However, as I reported when the new registration system became live, the law now requires that previously registered agents filed under the old paper system must re-file under the new electronic system no later than December 31. 2017.
You also have to re-file every three years. However, you can now designate your agent by a corporate title and if you wish to avoid naming a particular individual which might help make the process somewhat easier.
Don’t forget to file!
